Terms of Service

Who we are

Calendizer is a service of Infinite Waves SpA, tax ID (RUT) 78.271.723-5, with its registered address at Av. Presidente Kennedy 7440, office 701, Vitacura, Santiago, Chile. For any question about these terms, write to us at privacidad@calendizer.ai.

What Calendizer is

A tool for independent professionals to schedule their appointments, manage their clients and send them notices and reminders. Today it is free and under active development: we add, change and remove features as we learn what works. If we charge for the service, or for part of it, in the future, we will tell you by email and in the app at least 30 days in advance, and you will only be charged if you expressly accept; if not, you can download your data and delete your account at no cost.

Acceptance

By creating your account or using Calendizer you accept these terms and the Privacy Policy. If you do not agree with them, do not use the service. Calendizer is for professionals aged 18 or older. We keep a record of which version of these texts you accepted and when.

Your account

You are responsible for what happens in your account and for keeping your password safe. If you notice use you do not recognize, tell us right away at privacidad@calendizer.ai.

Your clients’ data and our role

The personal data of your clients continues to belong to the people it concerns. You decide why and how you process it and, for that processing, you are the controller. Calendizer processes it on your behalf and following your instructions in order to provide the service to you, as a processor under Law 19.628 on the protection of personal data, as amended by Law 21.719. The following points, up to “When it ends”, are the data processing agreement between you and Calendizer.

Details of the processing

Subject matter: providing Calendizer to you. Duration: as long as you have an account. Purpose: scheduling, managing your clients, sending them the notices and reminders you set up, and responding to what you ask the assistant. Types of data: identification and contact details (name, WhatsApp, email), schedule (appointments and classes), commercial data (services, packs and payments), the notes you write —which may include sensitive data, such as health data— and the log of notices sent. Data subjects: your clients and the other people you record. Instructions: these terms and the ones you give by using the app.

What we do with your clients’ data

We process it only to the extent necessary to provide Calendizer to you and following your instructions: storing it, showing it to you, letting you manage it, sending the notices and reminders you set up, and handling the requests you make through the assistant. We do not use it for our own purposes, we do not sell it, we do not use it for advertising and we do not combine it with the data of other accounts. The people who work with us are bound by confidentiality obligations.

Providers that help us

To provide the service we use technology providers that process data on our behalf, under instructions, confidentiality and data protection measures. You authorize us to use as sub-processors the providers we identify in the Privacy Policy, to the extent necessary to provide Calendizer to you. The current list is always in the Privacy Policy, and before adding a new one that processes your clients’ data we will tell you in the app. If you do not agree, you can download your data and delete your account. If you need it for your record of processing activities or for an impact assessment, we will give you reasonable information about how we process the data.

Security and incidents

We apply reasonable technical and organizational measures to protect personal data against unauthorized access, loss, alteration, disclosure or destruction. If we detect a security breach that affects the confidentiality, integrity or availability of the data we process on your behalf, we will notify you without undue delay —where possible, within 72 hours of becoming aware of it— by email to your registered address and in the app, with the available information you reasonably need to meet your obligations to the Personal Data Protection Agency and to your clients.

When one of your clients exercises their rights

If a client asks you to access, rectify, delete, block or take their data, the app lets you do it: edit or delete the client, and download all your data from Settings (Configuración). If a request like that reaches us, we will pass it on to you without delay and help with whatever is within our reach.

What is up to you

As the controller of your clients’ data, you must have a lawful basis for each processing you carry out and meet the obligations you have toward the data subjects. The lawful basis may vary depending on the processing and will not necessarily be consent. You must also inform your clients where appropriate, upload only the data that is necessary, and make sure you have the right to process the information you enter. If you process sensitive data, including health data, you must have the corresponding legal authorization and, when required, the express consent of the data subject. For the notices you send through Calendizer you must also comply with the rules that apply to each type of communication: in particular, WhatsApp reminders require your client’s prior authorization, which you declare when you turn them on in their profile. You are answerable to your clients, third parties and the authority for processing you carry out without a lawful basis or without the required authorization, and for the harm that causes Calendizer. If you record data of children or adolescents, you must have the authorization of their parents or legal representatives and always process it in their best interest.

Calendizer is not a clinical record

Calendizer is a calendar. Its notes help you remember what you need about each client, but they are not a clinical record and do not replace the records the law requires you to keep as a health professional, such as the clinical record under Law 20.584, which must be kept for at least 15 years. If you are required to keep them, do it in a system built for that.

When it ends

You can delete your account whenever you want from Settings (Configuración); before that you can download your data. When you do, we immediately delete from our active systems your account data and the data we process on your behalf, and it disappears from automatic backups within the following 7 days, except for what we must keep because of a legal obligation. If we stop offering the service, we will tell you in advance so you can download it. If your account goes a year without activity —no login and no appointments in the last twelve months or upcoming— we will delete it, warning you by email one month before; logging in is enough to keep it.

Suspension or termination by us

We may suspend or close an account that breaks these terms or the law. Unless it is urgent or the law prevents it, we will tell you beforehand by email and you will have at least 15 days to download your data.

Intellectual property

Calendizer, its software, its brand and its design belong to Infinite Waves SpA. While you have an account, we give you a personal, non-exclusive, non-transferable license to use it. The data you upload is not ours: we only use it to provide the service to you.

Free service, no warranties

Calendizer is offered as is and may have interruptions, errors or changes. We may modify, suspend or discontinue certain features and, when reasonably possible, we will tell you in advance. Nothing in this section limits liabilities that by law cannot be excluded or limited.

Your calendar does not depend only on us

Calendizer is a support tool for organizing your calendar. The responsibility for checking your appointments, schedules, clients and professional commitments remains yours. To the extent permitted by law, we are not liable for indirect damages, loss of profit or consequences of decisions you make without verifying the information the application shows.

The assistant writes with AI

The assistant uses artificial intelligence to interpret your instructions and help you create, change or look up information in your calendar. It can make mistakes or misread an instruction: always check the result before treating it as final. Calendizer’s AI features do not by themselves make decisions that produce legal effects or similarly significant consequences for you or your clients.

Limit of liability

To the extent permitted by applicable law, we are not liable for indirect damages, loss of profit or losses arising from circumstances not attributable to Calendizer. Nothing in these terms limits liabilities that by law cannot be excluded or limited.

Acceptable use

Do not use Calendizer for anything illegal, to bother third parties, to send unsolicited communications or to impersonate others. We may suspend accounts that do.

Changes

We may update these terms. If the change is significant, we will tell you by email and in the app at least 30 days in advance and ask you to accept it. If you do not agree, you can download your data and delete your account before it takes effect, at no cost.

Notices

We will write to the email on your account and, when appropriate, in the app. Keep that email up to date. You can write to us at privacidad@calendizer.ai.

Governing law

These terms are governed by Chilean law. Any dispute will be submitted to the ordinary courts of Santiago, without prejudice to the rights the law gives you to sue where you live. If any clause is declared void, the others remain in force.
